These Terms of Use ("Terms") govern your access to and use of the Coach By Design Academy website, courses, assessments, coaching tools, certificates, and related services (collectively, the "Academy").
The Academy is operated by Triple Impact Coaching, doing business as Coach By Design Academy ("Coach By Design," "we," "us," or "our").
By creating an account, purchasing the Academy, or using the Academy, you agree to these Terms. If you do not agree, do not use the Academy.
You must be at least 18 years old and legally able to enter into a binding agreement to create an account or purchase the Academy.
If you are under 18, you may use the Academy only with the involvement and permission of a parent or legal guardian who agrees to these Terms on your behalf.
The Academy is designed for coaches and other adults who work with athletes. It is not directed to children under 13, and children under 13 may not create accounts or submit personal information.

You may not sell, transfer, share, or sublicense access to your account or course materials.
We may suspend access when reasonably necessary to investigate suspected fraud, unauthorized sharing, security threats, payment disputes, or violations of these Terms.
Individual enrollment currently costs $95 as a one-time payment, unless a different price or valid promotional offer is displayed during checkout.
Payments are processed by Stripe or another disclosed payment processor. We do not directly receive or store your complete payment-card number.
You authorize the payment processor to charge the price and any clearly disclosed applicable taxes. The Academy is not a recurring subscription unless the checkout page expressly states otherwise and you separately agree to recurring charges.

You may request a refund within 14 calendar days after purchase by emailing arvin@coachbydesign.com, provided that you have not attempted the final exam.
Duplicate charges, unauthorized charges, and technical failures will be reviewed individually. Nothing in this section limits rights that cannot lawfully be waived.
Approved refunds will ordinarily be returned to the original payment method. Processing times are controlled partly by the payment provider and financial institution.
Enrollment provides a limited, personal, nonexclusive, nontransferable, revocable right to access the Academy for your own educational and professional-development purposes.
We may improve, correct, reorganize, replace, or retire course content. If a material change substantially prevents you from receiving what you purchased, contact us and we will provide an appropriate remedy as required by law.
We do not guarantee uninterrupted access. Maintenance, service-provider interruptions, security events, or circumstances beyond our reasonable control may temporarily affect availability.

Assessment questions, scoring methods, and answer keys are confidential Academy materials.

We may invalidate an assessment, withhold or revoke a certificate, or require reassessment when we reasonably determine that fraud, impersonation, answer sharing, technical manipulation, or a material scoring error occurred. We will provide a reasonable opportunity to contact us about the decision.
A Coach By Design Academy certificate indicates that our records show the named participant completed the requirements in effect on the certificate's issue date.

Coaches remain responsible for knowing and following all applicable laws, organizational policies, safety requirements, and standards of care.
We may correct a certificate containing an administrative error. We may revoke a certificate obtained through fraud or material misconduct connected to the Academy.
Academy content is provided for education and professional development. It is not legal, medical, mental-health, safeguarding, employment, or emergency advice.
Coaching decisions depend on athlete age, development, health, ability, environment, organizational policy, and other circumstances. You are responsible for exercising professional judgment and seeking qualified advice where appropriate.
If an athlete may be injured, abused, endangered, or experiencing an emergency, follow applicable emergency and reporting procedures rather than relying on Academy content.
Do not submit unnecessary personal information about athletes.
When completing reflections, Try It at Practice observations, or other assignments:
We may remove submitted content that appears to disclose sensitive or unnecessary information about a minor.
You retain ownership of original content you submit, such as reflections and commitment plans.
You grant us a limited, nonexclusive license to host, store, reproduce, and display that content only as reasonably necessary to operate the Academy, provide feedback, maintain your records, protect the service, and comply with law.
We will not publicly identify you or use your submission as a testimonial or marketing example without separate permission.
You represent that you have the right to submit your content and that it does not violate another person's privacy, intellectual-property rights, or other legal rights.
The Academy — including its lessons, videos, written materials, graphics, assessments, frameworks, templates, downloads, designs, trademarks, and software — is owned by or licensed to Coach By Design and is protected by applicable law.
You may download or print materials that the Academy specifically makes available for your personal coaching use.

The Academy relies on third-party providers, which may include Stripe for payment processing, Supabase for authentication and data services, Vercel for hosting, and email-delivery providers.
Their services may be governed by their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control, but we remain responsible for our own obligations concerning the services we select and the information we provide to them.
We may send service-related communications concerning your account, payment, security, course progress, feedback, certificate, or changes to the Academy.
Where required, promotional emails will be sent only with the appropriate permission and will include a method to unsubscribe. You cannot opt out of essential account, transaction, or security messages while maintaining an active account.
Suggestions you voluntarily provide may be used to improve the Academy without compensation, provided we do not publicly identify you without permission.
You may stop using the Academy at any time and may request account deletion as described in the Privacy Policy.
We may suspend or terminate access for a material violation of these Terms, fraud, abuse, security risk, unlawful activity, or nonpayment.
Where reasonably possible, we will provide notice and an opportunity to correct the issue. Immediate action may be taken when necessary to protect users, minors, the Academy, or third parties.
Termination does not eliminate payment obligations already incurred or provisions that logically survive termination, including intellectual-property, disclaimer, liability, and dispute provisions.
To the fullest extent permitted by law, the Academy is provided "as is" and "as available."
We do not guarantee:
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
To the fullest extent permitted by law, Coach By Design and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, opportunities, goodwill, or data arising from the Academy.
To the fullest extent permitted by law, our total liability arising from the Academy will not exceed the greater of:
These limitations do not apply where prohibited by law or to liability that cannot legally be limited, which may include liability for fraud, willful misconduct, or certain personal injuries.
To the extent permitted by law, you agree to indemnify and hold Coach By Design harmless from third-party claims resulting from your unlawful use of the Academy, your infringement of another person's rights, or content you submit in violation of these Terms.
This provision does not require you to indemnify us for our own negligence, misconduct, or violation of law.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Before filing a formal claim, you and Coach By Design agree to make a good-faith effort to resolve the matter by sending written notice to the contact information below and allowing 30 days for a response.
Any legal proceeding that is not resolved informally will be brought in the state or federal courts located in Pierce County, Washington, unless applicable consumer law gives you the right to proceed elsewhere.
Nothing in this section prevents either party from seeking appropriate relief in small-claims court or requesting urgent relief to protect intellectual-property, privacy, or security rights.
We may update these Terms to reflect changes in the Academy, law, or our business practices.
We will post the updated Terms with a revised effective date. If a change materially affects existing users, we will provide additional notice where reasonably appropriate or legally required.
Changes will apply prospectively unless law permits otherwise.
If one provision is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver.
You may not transfer these Terms without our permission. We may transfer them as part of a merger, reorganization, financing, or sale of the business, subject to applicable law and the Privacy Policy.
These Terms, the Privacy Policy, the checkout terms, and any expressly incorporated policies form the agreement between you and Coach By Design concerning the Academy.
